Signing is easy.
Swearing it's true is the point.
A sworn declaration is a written statement you sign and swear is true. When it's notarized as a jurat, California law (Government Code §8202) requires two things that an ordinary acknowledgment does not: you must personally appear before the notary, and you must take an oath or affirmation that the contents are true. The notary then watches you sign and completes the jurat certificate.
That's the part people miss. With a jurat, the signer signs in the notary's presence — you can't sign ahead of time and drop it off. If a document says "subscribed and sworn to before me," it needs a jurat, and it needs the oath. Skip the oath, and the notarization is defective even if the stamp is there. What's the difference between a jurat and an acknowledgment?
An acknowledgment (Civil Code §1189) confirms you're the person who signed a document — you don't swear anything, and you can sign beforehand. A jurat (Government Code §8202) is for sworn statements: you must appear in person, take an oath or affirmation that the contents are true, and sign in the notary's presence. Your document's notarial wording tells you which one you need. If it says "subscribed and sworn," it's a jurat.
What's the difference between a jurat and an acknowledgment?
Not always. Under Code of Civil Procedure §2015.5, California lets you sign many declarations "under penalty of perjury" without a notary — that's why lots of court declarations aren't notarized. But when a court, agency, or the document itself specifically requires a jurat or a "sworn" statement, you'll need a notary to administer the oath. We can't advise which your case requires — check the form or ask the court clerk — but if a jurat is called for, we handle it.
Do I have to appear in person for a jurat?
Yes. A jurat requires personal appearance. You must be physically present so the notary can verify your ID, administer the oath, and watch you sign. There's no way around in-person appearance for a sworn statement — but that's the whole point of us being mobile: we come to you in Clayton.
