What is the Notice of Right to Cancel on a refinance?
When you refinance the mortgage on your primary home, federal law (the Truth in Lending Act and Regulation Z) gives you a three-business-day "right of rescission" — a window to cancel the loan for any reason with no penalty. At signing you receive two copies of a notice explaining this right. As your signing agent, we make sure both copies are handed to every borrower and show you where the deadline date is written. We can't give legal advice about your loan — questions about your specific terms go to your lender.
How does the 3-day rescission period work for a refinance?
The three-business-day clock starts on the last of three events: you've signed the credit contract (the note), you've received your Truth in Lending / Closing Disclosure, and you've received your two copies of the Notice of Right to Cancel. Under the rule, Saturdays count as business days but Sundays and federal holidays do not. So if you sign on a Friday with no holiday in between, your window generally runs to midnight the following Tuesday. To cancel, your written notice must be sent before that deadline. Your lender is the authority on your exact dates — we point you to the notice; we don't set or interpret the deadline for you.
When does the right to cancel start — at signing or after?
It starts once all three trigger events have happened, which on a typical refinance is at your signing appointment: you sign the note, you get the disclosure, and you get the two cancel notices. The first business day after that counts as day one. Cancellation is effective when you mail or transmit your written notice — not when the lender receives it — so don't wait until the last minute.
Can you waive the three-day right to rescind?
In limited cases. Federal rules allow a borrower to waive or shorten the rescission period only for a bona fide personal financial emergency, and it requires a specific dated, signed written statement — a printed form doesn't count. This is a decision between you and your lender, not something a notary or signing agent handles or advises on. If your package includes a waiver, we notarize or witness only what the lender's instructions specify.
Does a refinance signing need a notary, or just witnesses?
The deed of trust and certain other documents in a refinance package must be notarized — that's the whole reason a signing agent comes out. California does not generally require separate witnesses for a standard refinance signing the way some states do; the notarization is the required step.
