Do Medical Documents Have to Be Notarized in California?
Often, no — and we’d rather tell you that up front. Most California healthcare documents don’t strictly require a notary at all. An advance healthcare directive can be made valid either by the signatures of two qualified witnesses or by acknowledgment before a notary public (Probate Code § 4673) — you choose the path, and one is enough. A POLST form is a physician’s order signed by the patient and doctor; it generally needs no notary or witness to take effect. And a HIPAA authorization usually just needs the patient’s signature. That’s why “do I even need a notary for this?” is a fair question — and the honest answer is often “not legally, but it depends on who’s receiving it.”
So when do you actually need a notary?
Plenty of times — and this is where families get caught out:
- The document itself calls for it. Some medical and durable powers of attorney include notarial or acknowledgment wording. If the form has a notary block, it needs a notary — no substitute.
- The institution insists on it. Hospitals, banks handling a financial POA, title companies, and insurers set their own rules and routinely want a notarial seal even when the Probate Code would allow witnesses instead.
- The signer is in a skilled nursing facility. This is the one most people miss: under Probate Code § 4675, an SNF patient’s advance directive isn’t effective unless a patient advocate or ombudsman also signs as a witness — either as one of two witnesses or in addition to notarization. - A financial or durable POA is involved. Powers of attorney that authorize financial decisions are frequently notarized as a matter of practice, and many institutions won’t honor one without it.
- It’s going out of state or abroad. Another state’s court, or a foreign government, will often want it notarized first — and for overseas use, an apostille or consular legalization on top, depending on the destination country.
