Do Affidavits Have to Be Notarized in California?

Often, no — and we’d rather tell you that up front. Under California Code of Civil Procedure §2015.5, almost anywhere state law lets a matter be proved by a sworn affidavit, it can instead be proved by an unsworn declaration under penalty of perjury. No notary involved. The declaration simply has to state the date and place it was executed and carry the statutory wording: “I certify (or declare) under penalty of perjury that the foregoing is true and correct.” That’s why most California court filings use declarations, not notarized affidavits.
